
Divorce mediation: you only get one shot, make it work!

Here is how I prepare for mediation in 5 simple steps. Most times this process takes me between 2 to 5 (billable) hours depending on the complexity of the case.
- Update all categories on the Financial Dec and select/ double check which line items shall populate an AD worksheet. Make sure you can support all values with current financial statements.
- Work up your asset division best case scenario. I will usually do this in column A, leaving column B for what is actually agreed to during mediation.
- Run/ double check child support (if kids are involved). If a shared parenting plan is on the table, run several worksheets contemplating various overnight scenarios.
- Is it an alimony case? If so, run some scenarios by either targeting a specific income or calculating each person's net disposable income. Look to the asset division sheet to see if a lump sum payment (payoff?!) may be something you want to discuss during mediation.
- Write your position statement, scan all documents and email everything to your mediator.
